1. Eligibility
You must be at least 18 years of age (or 14 with verifiable parental consent in Spain) to use the Service. By accepting these Terms, you represent that you meet this requirement. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Account Registration
You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account at auth@acopio.dev.
3. Plans and Pricing
The Service is available under a free tier and paid subscription plans (Pro and Unlimited). Current pricing and plan features are described on the Pricing page and on your Billing page.
Paid subscriptions are billed in advance on a monthly or annual basis. Billing is handled by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. By subscribing, you also agree to Paddle's terms of service.
4. Right of Withdrawal and Refunds
Under Spanish and EU consumer law (Real Decreto Legislativo 1/2007, Art. 102), consumers ordinarily have a 14-day right of withdrawal from distance contracts. However, pursuant to Art. 103.m of the same law, this right does not apply to the supply of digital content or digital services that have begun to be performed with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal. That consent and acknowledgment are collected during the checkout process managed by Paddle.
If service has not yet begun (e.g. you subscribed but never accessed any paid feature), you may request a full refund within 14 days of purchase by contacting billing@acopio.dev. All other refund requests are at our sole discretion. We do not offer pro-rata refunds for unused time on active subscriptions.
5. Cancellation
You may cancel your subscription at any time through the Paddle customer portal accessible from your Billing page. Cancellation takes effect at the end of the current billing period. Your data remains accessible until that date.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the Service or its infrastructure.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service to transmit malware, spam, or unsolicited communications.
- Resell or sublicense access to the Service without our written consent.
7. Intellectual Property
The Service and all its components are protected by intellectual property law. You retain ownership of content you create in the Service. You grant us a limited licence to process and display that content solely to provide the Service, as further described in our Legal Notice.
8. Suspension and Termination
We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees after a grace period, or engage in conduct that we reasonably believe harms other users or the Service. Where possible, we will give you notice before suspension. You may request deletion of your account and associated data at any time.
9. Warranties and Liability
The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. To the maximum extent permitted by applicable law, our total liability for claims arising under or in connection with these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Spanish law.
10. Changes to the Service and Terms
We may modify the Service or these Terms at any time. Material changes to Terms will be communicated by email at least 30 days in advance. Continued use of the Service after the effective date of changes constitutes acceptance. If you disagree, you may cancel your subscription before the changes take effect.
11. Governing Law and Dispute Resolution
These Terms are governed by Spanish law. Consumer users in the EU retain the benefit of any mandatory consumer protection provisions that apply in their country of residence. For B2B disputes, the parties submit to the exclusive jurisdiction of the courts of Barcelona. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
